At the July 15 special meeting, City Council approved a rule that provides guidance for one part of the new law that limits residential growth in Lakewood. The new law went into effect on July 12 when the official election results were certified, and it includes a starting date of Jan. 1, 2020, for an allocation process for developments to receive building permits. The new law is clear that developments with building permits applications accepted prior to July 12 can proceed without an allocation. The new law, however, does not specifically address how to handle developments on course to receive a building permit between the interim period from July 12 to Jan. 1, 2020.

City Council had the July 15 special meeting to address this issue. Because the new law specifically allows City Council to adopt rules needed to administer it, council approved a resolution that clarifies how developments will be handled within this interim period. The resolution provides that developments that have completed all other necessary steps in the development review process and need only to obtain a building permit may proceed during this interim period to receive a building permit before the end of the year without an allocation. 

Developments that do not already have building permits or do not fit within the provisions of the resolution for the interim period may apply for an allocation when that process begins in January 2020.
