Building Permits During the Transition

During the transition, if Ballot Question 200 is approved by Lakewood voters, how will it be determined if a Building Permit requires an Allocation? The term Building Permit, as used herein, also includes a permit to Set-up a mobile home. A bold font is used herein to identify terms defined in Ballot Question 200.
The following is the best available information recognizing the new nature of Ballot Question 200 in the Lakewood process. Updates may occur.
- Allocations are not necessary for any Building Permit that does not include any residential Dwelling Units.
- If a Building Permit application is accepted by the city prior to certification of the election result, Allocations are not necessary for the associated Building Permits. Certification of the election results is anticipated to occur soon after the election date of July 2, 2019.
- Allocations are not necessary for Building Permits approved, paid for and picked-up in 2019. Time from city acceptance of a Building Permit application to a Building Permit being issued can be months depending on multiple factors including building complexity, submittal quality, and other applications in the queue.
- Allocations equal to the number of Dwelling Units in each building are necessary for all other Building Permits unless such building is exempt or an exception exists pursuant to Ballot Question 200.
Exceptions and Exemptions: Ballot Question 200’s Implementation/Exceptions section identifies specific types of projects for which Allocations are not necessary to obtain a Building Permit regardless of when the Building Permit is obtained. General Provision 3 in Ballot Question 200 provides an exemption process that may be used to exempt specific Developments from the Allocation requirements.
Expiration and Validity: Building Permit application acceptance and Building Permit approval can expire. If expiration of a Building Permit application or Building Permit occurs, the process will begin anew including determination of whether Allocation(s) are required for issuance of a Building Permit. Allocations are valid for a limited time as defined by Ballot Question 200. Also, each Allocation is used, and no longer available, upon issuance of a Building Permit associated with such Allocation.
Building Permit Applications: Building Permit applications are accepted for review by the city no earlier than when a site plan, if required for the project, has been confirmed to be far enough along to establish the building footprint and building elevations (i.e., exterior components of the building that are inputs to the review of a building plan submittal). Jefferson County Health Department approval, if required by a project, is necessary prior to city acceptance of a Building Permit application. There is also a checklist for Building Permit application contents necessary before a Building Permit application is accepted for review. Submittal to West Metro Fire Rescue can be concurrent with application to the city.
Building Permit Application Quality: The content and quality requirements for a Building Permit application will not be varied as deadlines approach.
