Requests for a continuance can be made in person, by email, fax or over the telephone prior to your court date. If you are under the age 18, in the majority of cases you will need to appear with a parent or legal guardian. The parent of a juvenile may continue the case without the juvenile’s presence when identification is provided. Attorneys requesting a continuance must file the appropriate motions with the court.
An arraignment may be continued one time for up to two weeks. Additional continuances, or continuances longer than two weeks, must be approved by a judge.
To continue a trial, a waiver of the right to a speedy trial and an appearance before a judge may be required.
You may request a public defender at your arraignment.
You must be facing the possibility of jail time.
You must qualify financially.
Financial documentation must be provided to the court at the time of application to determine financial eligibility.
