A RESOLUTION

AUTHORIZING AN INTERGOVERNMENTAL AGREEMENT WITH THE URBAN DRAINAGE AND FLOOD CONTROL DISTRICT TO UPDATE THE OUTFALL SYSTEMS PLAN FOR NORTH DRY GULCH

WHEREAS, the Urban Drainage and Flood Control District (UDFCD) and the City of Lakewood (Lakewood) participated in developing an Outfall Systems Plan in 1995 for North Dry Gulch; and

WHEREAS, UDFCD and Lakewood would like to update the current Outfall Systems Plan for North Dry Gulch; and

WHEREAS, UDFCD and Lakewood would like to enter into an Intergovernmental Agreement to fund the update of the Outfall Systems Plan for North Dry Gulch.

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Lakewood, Colorado, that:

SECTION 1.  The City Manager is hereby authorized to execute and the City Clerk to attest to an Intergovernmental Agreement with the Urban Drainage and Flood Control District for an Outfall Systems Planning Update for North Dry Gulch, in form approved by the City Attorney, in an amount not to exceed One Hundred Fifty Thousand Dollars ($150,000.00), with the City’s contribution not to exceed Seventy Five Thousand ($75,000.00).

SECTION 2.  The City Treasurer is hereby authorized to make payment of the City’s contribution to the Urban Drainage and Flood Control District in accordance with the terms of said Intergovernmental Agreement.

INTRODUCED, READ AND ADOPTED by a vote of 10 for and 0 against at a regular meeting of the City Council on September 28, 2009, at 7 o'clock p.m. at Lakewood City Hall, 480 South Allison Parkway, Lakewood, Colorado.
