A RESOLUTION
AUTHORIZING THE FIRST AMENDMENT TO THE INTERGOVERMENTAL AGREEMENT BETWEEN THE TOWN OF MORRISON, COLORADO AND THE CITY OF LAKEWOOD, COLORADO REGARDING THE ROONEY VALLEY
WHEREAS, the City of Lakewood (the “City”) and the Town of Morrison (the “Town”) entered into an Intergovernmental Agreement Regarding the Rooney Valley in May 2000; and
WHEREAS, pursuant to the IGA the Joint Project Review Committee could enter into development agreements with property owners, which agreements could address, among other things, the vesting of property rights, but the IGA was not clear as to whether such vested property rights could exceed three (3) years in duration; and
WHEREAS, the City and the Town desire to amend the IGA to clarify that such development agreements may provide that an approved Phase 1 Final Development Plan may be a vested property right for a specified period, which period may exceed three (3) years.
NOW, THEREFORE, BE IT RESOLVED by the City Council of Lakewood, Colorado, that:
SECTION 1. The City Manager is hereby authorized to execute, and the City Clerk to attest, the First Amendment to Intergovernmental Agreement between the Town of Morrison, Colorado and the City of Lakewood, Colorado Regarding the Rooney Valley, in a form approved by the City Attorney.
INTRODUCED, READ AND ADOPTED by a vote of 11 for and 0 against at a regular meeting of the City Council on September 14, 2009, at 7 o’clock p.m. at Lakewood Civic Center, 480 South Allison Parkway, Lakewood, Colorado.
