REQUEST FOR COUNCIL ACTION
RESOLUTION: 2009-43
SUBJECT: Approval to enter into an Intergovernmental Agreement between the City of Lakewood and the Regional Transportation District Regarding Noise Barrier Alternative Treatment Options along the West Corridor Light Rail Line.

RECOMMENDATION: The Planning and Public Works Department recommends City Council’s approval to enter into an Intergovernmental Agreement (IGA) between the City of Lakewood and the Regional Transportation District (RTD) Regarding Noise Barrier Alternative Treatment Options.
FUNDING SOURCES: The Regional Transportation District (two-thirds) and the City of Lakewood Capital Improvement Fund (one-third)
SUMMARY AND BACKGROUND OF SUBJECT MATTER: RTD is constructing the West Corridor light rail line, a portion of which will run through the City of Lakewood. As part of the light rail project, RTD will be constructing 6-foot noise barriers along segments of RTD’s right-of-way where necessary to meet the Federal Transit Administration’s requirements for sound mitigation.
The City of Lakewood and RTD have designed and developed the Noise Barrier Alternative Treatment Options program to provide reasonable alternatives to RTD’s standard noise barrier program to qualified property owners. The City Council discussed the proposed program at a Study Session November 3, 2008. City Council consensus was to proceed with the Noise Barrier Alternative Treatment Options program and that the City’s share of costs be funded from the Capital Improvement Fund. This IGA is an implementation step pursuant to Council’s direction.
The Alternative Treatment Options program provides up to $105 per linear foot of property fronting the track to qualified property owners for insulated windows, landscaping, fencing, or any combination thereof. Fourteen qualified property owners have selected the Noise Barrier Alternative Treatment Option.
A property owner is qualified for the Alternative Treatment Options program only if the owner’s property is contiguous to locations identified to receive noise barriers in the Denver West Corridor Project Noise Assessment prepared for RTD and if such owner either:
The City of Lakewood is responsible for managing the Noise Barrier Alternative Treatment Options program, which includes entering into an agreement with individual qualified property owners to outline each party’s responsibilities and duties. RTD will be responsible for reimbursing the City for RTD’s portion of the costs associated with the Noise Barrier Alternative Treatment Option.
Project funding is as follows:
The total cost to the City of Lakewood is $58,000.
The Regional Transportation District has indicated it will fully cooperate with the Noise Barrier Alternative Treatment Options program, and all activities and responsibilities set forth in the Intergovernmental Agreement.
