A RESOLUTION

AUTHORIZING  THE CITY  OF  LAKEWOOD  TO  ENTER  INTO  AN INTERGOVERNMENTAL  AGREEMENT  (IGA)  WITH  THE  REGIONAL TRANSPORTATION DISTRICT (RTD) REGARDING NOISE BARRIER ALTERNATIVE TREATMENT OPTIONS FOR THE WEST CORRIDOR LIGHT RAIL PROJECT

WHEREAS, RTD is constructing the West Corridor light rail line, a portion of which will run through the City of Lakewood; and

WHEREAS, Federal Transit Administration requires RTD to provide noise mitigation for certain residential properties impacted by the light rail line; and

WHEREAS, RTD developed a Standard Barrier Program and identified 6-foot noise barriers as the most appropriate method for sound mitigation; and

WHEREAS, City of Lakewood and RTD have collaborated on the development of a Noise Barrier Alternative Treatment Options program to provide reasonable alternatives to qualified property owners; and

WHEREAS, the Noise Barrier Alternative Treatment Options program provides certain alternatives including insulated windows, landscaping, and fencing to qualified property owners; and

WHEREAS, City of Lakewood and RTD have agreed to execute an Intergovernmental Agreement that outlines the scope of services and responsibilities for the Noise Barrier Alternative Treatment Options program.

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Lakewood, Colorado, that:

SECTION 1.  The City Manager is hereby authorized to execute, and the City Clerk to attest, an Intergovernmental Agreement Between the City of Lakewood and the Regional Transportation District Regarding Noise Barrier Alternative Treatment Options for the West Corridor light rail project.

SECTION 2.  Funding for the City’s share of the cost of alternative treatments shall be from the Capital Improvement Fund.

INTRODUCED, READ AND ADOPTED by a vote of 11 for and 0 against at a regular meeting of the City Council on September 14, 2009, at 7 o’clock p.m. at Lakewood Civic Center, 480 South Allison Parkway, Lakewood, Colorado.
