REQUEST FOR COUNCIL ACTION
RESOLUTION: 2009-42
SUBJECT: Authorizing a further extension of the deadline to file a Service Plan Amendment for Fossil Ridge Metropolitan District No. 4.
RECOMMENDATION: Approve Resolution 2009–42 to extend the deadline for an additional two years until December 31, 2011 for Fossil Ridge Metropolitan District No. 4 to submit an amended service plan.

SUMMARY AND BACKGROUND OF SUBJECT MATTER: On August 8, 2005, the Lakewood City Council conditionally approved a Service Plan for the Fossil Ridge Metropolitan District Nos.1-4. Subsequently, at an election held on November 1, 2005, the eligible electors of the Districts approved the formation of District Nos. 1-4. District Nos. 1-3 generally include the residential property owned by Carma and District No. 4 generally includes the recently rezoned property owned by CDN. As required by the Council’s conditional approval in 2005, Districts 1-3 submitted and received approval by Council of an Amended Service Plan in 2006, which was further amended by the Second Amended and Restated Service Plan approved by Council on August 27, 2007.
Pursuant to the Second Amended and Restated Service Plan, District No. 4 was to submit a service plan amendment, with a full financing plan and description of the improvements to be constructed and services to be provided by District No. 4, to be approved by Council by December 31, 2008. Because of economic conditions last year, the property owners in District No. 4 requested and received a one-year extension from Council, until December 31, 2009, to submit the amended service plan. The property owners have again asked for an extension, but this time for two years until December 31, 2011 because the economic conditions have not improved and are not expected to improve significantly in the next year. Because development plans have not progressed to the point of identifying facilities and services to be provided by District No. 4 and the costs thereof, staff recommends approval of this two-year extension.
