A RESOLUTION
AUTHORIZING THE EXECUTION OF AN AGREEMENT WITH METRO WEST HOUSING SOLUTIONS AND ACCEPTING A SPECIAL WARRANTY DEED FROM METRO WEST HOUSING SOLUTIONS TO THE CITY OF LAKEWOOD FOR THE CONVEYANCE OF PROPERTY LOCATED ON WEST 11TH AVENUE, BETWEEN HARLAN STREET AND LAMAR STREET, FOR THE NEW COMMUNITY CENTER THAT WILL BE CONSTRUCTED FOR THE HEAD START PROGRAM, LOCATED WITHIN THE CITY LIMITS OF THE CITY OF LAKEWOOD
WHEREAS, the City wishes to execute an Agreement to acquire property that will be used to construct a new Head Start facility, and;
WHEREAS, Metro West Housing Solutions will tender to the City of Lakewood a Special Warranty Deed for the property;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Lakewood, Colorado, that:
SECTION 1. The City Manager is hereby authorized to execute, and the City Clerk to attest, an Agreement, in form approved by the City Attorney, to acquire property in consideration of the City constructing a Head Start facility thereon. The real property is described in Exhibit “A” attached hereto and made a part hereof.
SECTION 2. The City of Lakewood does hereby accept the aforesaid Special Warranty Deed.
SECTION 3. The City Clerk is authorized and directed to record a certified copy of this Resolution with the Jefferson County Clerk and Recorder.
INTRODUCED, READ AND ADOPTED by a vote of 11 for and 0 against at a regular meeting of the City Council on August 24, 2009, at 7 o’clock p.m. at Lakewood Civic Center, 480 South Allison Parkway, Lakewood, Colorado.

Exhibit A
A parcel of land being a portion of Block 11, LAKEWOOD, the plat of which is recorded in Plat Book 2, Pages 14 & 15, of the records of the Jefferson County Clerk and Recorder, TOGETHER WITH a portion of the West half of vacated Jay Street (platted Second Street) by Book 2798, Page 937 of said records, TOGETHER WITH a portion of the vacated alley in said Block 11, by Book 1579, Page 289 of said records, further lying in the Northwest One-Quarter (NW¼) of Section 1, Township 4 South, Range 69 West of the 6th Principal Meridian, City of Lakewood, County of Jefferson, State of Colorado, being more particularly described as follows:
Commencing at the Northeast corner of said NW¼; thence S 00°00'32" E along the East line of said NW¼ (Basis of Bearing: based on the North line of said NW¼, which is assumed to bear N 89°31’07” E, all other bearings herein related thereto), a distance of 2,002.10 feet, more or less, to the centerline of West 11th Avenue as shown and platted as Park Avenue on said LAKEWOOD; thence S 89°28'55" W along said centerline, a distance of 635.71 feet, more or less, to the southerly extended centerline of said vacated Jay Street (platted Second Street); thence N 00°27'59" W along the southerly extended centerline of said Jay Street, a distance of 30.00 feet, more or less, to the intersection of said southerly extended centerline with the easterly extended South line of said Block 11, said intersection being the True Point of Beginning; thence
S 89°28'55" W along said easterly extended South line and the South line of said Block 11, said easterly extended South line and South line being in common with the North right-of-way line of said West 11th Avenue (platted Park Avenue), a distance of 196.28 feet, more or less, to the East line of the West 99.40 feet of said Block 11; thence
N 00°27'59" W along said last East line, a distance of 130.17 feet; thence leaving said last East line S 89°37'25" E, a distance of 196.30 feet, more or less, to the centerline of said vacated Jay Street (platted Second Street); thence S 00°27'59" E along said last centerline, a distance of 127.11 feet, more or less, to the True Point of Beginning, said parcel containing an area of 25,249 square feet, more or less.
