RESOLUTION:  2009-29  

SUBJECT:  Support of S 757 and HR 1828 – the “Charlie Wolf Nuclear Workers Compensation Act.”

RECOMMENDATION:  Approval

SUMMARY AND BACKGROUND OF SUBJECT MATTER: 

This proposed federal legislation has been jointly sponsored and introduced in both the U.S. Senate and the House of Representatives by Senator Mark Udall and Representative Jared Polis. The bill seeks to reform the Energy Employees Occupational Illness Compensation Program Act of 2000 to make it more effective in considering compensation claims by workers who may have become ill due to exposures at nuclear weapons facilities, such as Rocky Flats in Jefferson County.

The bill is named after an employee of Rocky Flats who died this year as the result of brain tumors that were likely the result of exposure to toxic and radioactive materials at the weapons facility. He and his family spent seven years seeking compensation.

This bill expands the categories of workers eligible for compensation, improves and streamlines the application and approval process for workers or their survivors, and enhances transparency of the program in requiring any claim denials to be written in a language that is clear, concise and easily understood.
