REQUEST FOR COUNCIL ACTION
RESOLUTION: 2009-19
SUBJECT: Resolution authorizing the City Manager to sign a Revocable License Agreement to allow the installation of an irrigation pipe within City R.O.W.
ADDRESS: West Mississippi Avenue (between South Butler Way and South Balsam Street) and South Balsam Street (between West Mississippi Avenue and West Tennessee Avenue.
RECOMMENDATION: Staff recommends approval of this resolution authorizing the Revocable License Agreement

SUMMARY AND BACKGROUND OF SUBJECT MATTER: The City of Lakewood has been asked by Joan and David Young to allow for the relocation of an existing irrigation ditch lateral from private property onto existing and proposed City R.O.W. This request is in conjunction with the Richland Gardens Filing No. 2 subdivision plat, which was approved by the City Planning Commission on April 15th. A condition of that approval was that the Youngs, together with the developer of the Richland Gardens property, work out an arrangement for the relocation of the existing irrigation ditch lateral and enter into a Revocable License Agreement with the City.
The newly relocated irrigation lateral will be piped along the edge of the existing R.O.W. for West Mississippi Avenue and the proposed section of South Balsam Street, which is being dedicated with the aforementioned plat. This relocation will be a benefit to the Youngs, the Gillcrists (co-licensees, who own the adjacent property), and the developer of the Richland Gardens plat. Other than crossings, the new pipe will be outside of the road improvements, along the edge of the public rights-of-ways. The licensees will be solely responsible for the installation and ongoing maintenance of the irrigation pipe.
