A RESOLUTION

AUTHORIZING SIGNATURE OF A REVOCABLE LICENSE AGREEMENT FOR AN IRRIGATION PIPE AND RELATED APPURTENANCES WITH JOAN C. YOUNG, DAVID R. YOUNG, EDWARD GILLCRIST, AND ANNETTE L. GILLCRIST FOR PORTIONS OF WEST MISSISSIPPI AVENUE AND SOUTH BALSAM STREET

WHEREAS, the Licensees own property at 8135 and 8145 W. Mississippi Ave. in the City of Lakewood, Jefferson County, Colorado; and

WHEREAS, the Licensees are currently served by an irrigation ditch lateral that they wish to relocate within City right-of-way; and

WHEREAS, it is necessary and desirable to allow Licensees to use a portion of the land owned by the City along West Mississippi Avenue (behind the north sidewalk, between South Butler Way and South Balsam Street) and South Balsam Street (between West Mississippi Avenue and West Tennessee Avenue: and

WHEREAS, the Licensees accept the maintenance responsibility for the licensed property, associated with the licensed improvements, in keeping with the terms and conditions imposed by the City.

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Lakewood, Colorado, that:

SECTION 1.  The City Manager is hereby authorized to sign, and the City Clerk to attest, a Revocable License Agreement, in form approved by the City Attorney, for an irrigation pipe and related appurtenances.

INTRODUCED, READ AND ADOPTED by a vote of 10 for and 0 against at a regular meeting of the City Council on May 11, 2009, at 7 o’clock p.m. at the Lakewood Civic Center, 480 South Allison Parkway, Lakewood, Colorado.
