A RESOLUTION
ESTABLISHING A BUSINESS RELOCATION POLICY FOR BUSINESSES RELOCATING WITHIN
THE CITY OF LAKEWOOD AS A RESULT OF RTD'S WEST CORRIDOR LIGHT RAIL PROJECT
WHEREAS, construction is under way on the Regional Transportation District's
(RTD) West Corridor Light Rail line through the City of Lakewood; and
WHEREAS, RTD has begun the process of acquiring properties needed for construction
of the West Corridor line, in some cases through eminent domain; and
WHEREAS, the Lakewood City Council, recognizing the significant negative impact
of the West Corridor line on those businesses that are forced to relocate, and
desiring to encourage such businesses to continue operating within Lakewood,
has appropriated a sum of money in the Revised 2008 Budget for the establishment
of a business relocation program designed to provide financial assistance for
certain qualified business owners who choose to relocate their businesses elsewhere
in the City.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Lakewood,
that:
Section 1. The City of Lakewood West Corridor Light Rail Business Relocation
Policy ("Relocation Policy") attached hereto is hereby adopted.
Section 2. The voluntary payment by the City of Relocation Benefits for businesses
displaced by the West Corridor Light Rail line shall be contingent upon compliance
with the Relocation Policy.
Section 3. If any part, section, subsection, sentence, clause or phrase of this
Resolution or the Relocation Policy is for any reason held to be invalid, such
invalidity shall not affect the validity of the remaining provisions.
Section 4. This Resolution shall take effect and be enforced immediately upon
its approval by the City Council.
INTRODUCED, READ AND ADOPTED by a vote of 11 For and 0 Against at a regular meeting of the City Council on February 9, 2009, at 7 o'clock p.m. at the Lakewood Civic Center, 480 South Allison Parkway, Lakewood, Colorado.
