RFCA - R-2009-5 REQUEST FOR COUNCIL ACTION

RESOLUTION: 2009-5

SUBJECT: Resolution authorizing execution of an agreement to purchase one temporary easement and one permanent easement for the Colfax at Simms Street Intersection Improvement Project.

ADDRESS: 11501 - 11503 West Colfax Avenue.

RECOMMENDATION: Approval

SUMMARY AND BACKGROUND OF SUBJECT MATTER:

The purpose of the intersection improvements at West Colfax Avenue and Simms Street is to improve traffic flow and enhance safety. The project will widen Simms Street to add double left turns on the northbound side. Colfax Avenue will be widened to add double left turns on the westbound side and a right turn lane on the eastbound side. Sidewalks will also be added to both sides of both streets. The project required the City to acquire small parcels of land or easements along Simms and/or Colfax from 12 property owners. Acquisitions from 11 of those owners have previously been completed through negotiation. Approval of this Resolution would enable the City to acquire the easements from the final owner and proceed with construction.

Ordinance O-2006-20 approved acquisition of the necessary property rights and generally requires City Council approval by resolution of any agreement to acquire property for a purchase price in excess of Fifteen Thousand Dollars ($15,000). The owners of 11501-11503 West Colfax and the City have been negotiating and have agreed on a settlement figure of $80,000, and the proposed settlement has been approved by the CDOT review appraiser.
