AN ORDINANCE

GRANTING A FRANCHISE BY THE CITY OF LAKEWOOD TO PUBLIC SERVICE COMPANY OF COLORADO, ITS SUCCESSORS AND ASSIGNS, WHICH CONVEYS A NONEXCLUSIVE RIGHT TO FURNISH, SELL AND DISTRIBUTE GAS AND ELECTRICITY TO THE CITY AND TO ALL PERSONS, BUSINESSES AND INDUSTRY WITHIN THE CITY, AND ADDITIONAL RIGHTS RELATED THERETO

WHEREAS, the Public Service Company of Colorado has provided distribution of gas and electricity to the City of Lakewood and its citizens under a nonexclusive franchise for twenty years; and

WHEREAS, the City and the Public Service Company have negotiated a new franchise agreement to provide for the distribution of gas and electricity to the City of Lakewood and its citizens under a nonexclusive franchise for the next twenty years.

NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of Lakewood, Colorado, that:

SECTION 1.  The City Council hereby adopts the Franchise Agreement with the Public Service Company of Colorado attached hereto and incorporated herein as Exhibit A under the terms and conditions set forth in said Franchise Agreement.

SECTION 2.   The Mayor and City Manager are hereby authorized to sign, and the City Clerk to attest, the Franchise Agreement and related documents, in form approved by the City Attorney.

SECTION 3.  This Ordinance shall take effect thirty (30) days after final publication.

I hereby attest and certify that the within and foregoing ordinance was introduced and read on first reading at a regular meeting of the Lakewood City Council on the 23rd day of November, 2009; published in the Denver Post and on the City of Lakewood's website, www.lakewood.org, beginning the 24th day of November, 2009; set for public hearing on the 14th day of December, 2009, read, finally passed and adopted by the City Council on the14th day of December, 2009 and, signed and approved by the Mayor on the 15th day of December, 2009.
