REQUEST FOR COUNCIL ACTION
ORDINANCE: O-2009-42
SUBJECT: Covenant between the City of Lakewood and The State Board of the Great Outdoors Colorado Trust Fund (GOCO) regarding the continual maintenance of the ball field and related improvements at Coyote Gulch Park for park and recreational purposes.

RECOMMENDATION: The Department of Community Resources recommends that the City enter into a 25-year covenant with GOCO regarding the continued maintenance of the ball field and related improvements at Coyote Gulch Park for park and recreational purposes.
FUNDING SOURCE: NA
SUMMARY AND BACKGROUND OF SUBJECT MATTER: In September of 2008, the Department of Community Resources applied for and received a GOCO grant to fund the redevelopment of the ball field and related improvements at Coyote Gulch Park. The grant application and acceptance was authorized by Council Resolution R-2008-59.
As a condition of accepting the funding assistance, the GOCO grant agreement requires that the City enter into a covenant with GOCO pledging the continued maintenance of the improvements for park and recreational uses for (twenty-five) 25 years. This covenant is to be recorded on the property record for the site.
Section 7.1 of the City Charter requires that any action that “places a burden upon or limits the use of property” shall be by ordinance.
