AN ORDINANCE
TO ENTER INTO A COVENANT WITH THE STATE BOARD OF THE GREAT OUTDOORS COLORADO TRUST FUND REGARDING THE CONTINUED OPERATION AND MAINTENANCE OF COYOTE GULCH PARK BALL FIELD FOR PARK AND RECREATIONAL PURPOSES
WHEREAS, the City of Lakewood owns and operates the site known as Coyote Gulch Park located at 2501 South Gladiola Way for park and recreational purposes; and
WHEREAS, the City of Lakewood on January 18, 2009 entered into a grant agreement with The State Board of The Great Outdoors Colorado Trust Fund (GOCO) for the Coyote Gulch Park Improvements; and,
WHEREAS, in order to receive the grant reimbursement funds, the City of Lakewood is required to enter into and record on the property records of Coyote Gulch Park a covenant with GOCO for the continued operation and maintenance of the funded improvements for park and recreational purposes.
NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of Lakewood, Colorado, that:
Section 1. The City Council of the City of Lakewood, Colorado hereby declares its intent to operate and maintain in a reasonable state of repair, the ball field and related improvements at Coyote Gulch Park for park and recreational purposes.
Section 2. The City Council of the City of Lakewood, Colorado hereby authorizes the City Manager to sign and the City Clerk to attest, in form approved by the City Attorney, a covenant with GOCO that makes this declaration a part of the property record for the ball field and related improvements at Coyote Gulch Park for a period of (twenty-five) 25 years.
Section 3. The City Council of the City of Lakewood, Colorado hereby authorizes the City Clerk to record said covenant in the property records maintained by the County of Jefferson, Colorado.
I hereby attest and certify that the within and foregoing ordinance was introduced and read on first reading at a regular meeting of the Lakewood City Council on the 26th day of October, 2009; published by title in the Denver Post and in full on the City of Lakewood's website, www.lakewood.org, on the 29th day of October, 2009; set for public hearing on the 23rd day of November, 2009, read, finally passed and adopted by the City Council on the ____ day of November, 2009 and, signed and approved by the Mayor on the ____ day of November, 2009.
