AN ORDINANCE

TO ENTER INTO A COVENANT WITH THE STATE BOARD OF THE GREAT OUTDOORS COLORADO TRUST FUND REGARDING THE CONTINUED OPERATION AND MAINTENANCE OF RAY ROSS PARK FOR PARK AND RECREATIONAL PURPOSES

WHEREAS, the City of Lakewood owns and operates the site known as Ray Ross Park located at 680 South Harlan Street for park and recreational purposes; and

WHEREAS, the City of Lakewood on September 21, 2007 entered into a grant agreement with The State Board of The Great Outdoors Colorado Trust Fund (GOCO) for the Ray Ross Park Phase One Development; and

WHEREAS, the City of Lakewood on March 9, 2008 entered into a grant agreement with GOCO for the Ray Ross Park Phase Two Development (Exhibits A and B); and,

WHEREAS, in order to receive the grant reimbursement funding from both grants, the City of Lakewood is required to enter into and record on the property records of Ray Ross Park a covenant with GOCO for the continued operation and maintenance of the site for park and recreational purposes.

NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of Lakewood, Colorado, that:

Section 1. The City Council of the City of Lakewood, Colorado hereby declares its intent to operate and maintain Ray Ross Park in a reasonable state of repair, for park and recreational purposes.

Section 2. The City Council of the City of Lakewood, Colorado hereby authorizes the City Manager to sign and the City Clerk to attest, a covenant with GOCO, in a form approved by the City Attorney, that makes this declaration a part of the property record for Ray Ross Park for a period of twenty-five (25) years.

Section 3. The City Council of the City of Lakewood, Colorado hereby authorizes the City Clerk to record said covenant in the property records maintained by the County of Jefferson, Colorado.

I hereby attest and certify that the within and foregoing ordinance was introduced and read on first reading at a regular meeting of the Lakewood City Council on the 10th day of August 2009; published by title in the Denver Post and in full on the City of Lakewood's website, www.lakewood.org., on the 13th day of August 2009; set for public hearing on the 24th day of August 2009; read, finally passed and adopted by the City Council on the 24th day of August, 2009, and signed, and approved by the Mayor on the 25th day of August, 2009.
