REQUEST FOR COUNCIL ACTION
ORDINANCE: O-2009-38
SUBJECT: Placing two charter amendments on the regular municipal election ballot and declaring an emergency.
RECOMMENDATION: Adoption of the attached ordinance.
SUMMARY AND BACKGROUND OF SUBJECT MATTER: The attached ordinance reflects the recommendations of staff in two areas of Article XIII of the City Charter as it pertains to elections brought about by Initiative or Referendum Petitions.
City Charter - Article XIII – Initiative and Referendum: The proposed City Charter Amendments give City Council the option to (a) set an election brought about by an initiative or referendum petition not less than 30 days and not more than 120 days from the day the ordinance is brought forward to City Council; or (b) place the initiated or referred ordinance on the ballot for the first Tuesday in November, which would be a coordinated election with Jefferson County.
Coordinated elections have proven to be a cost savings to the City and typically generate higher voter turnout. Giving City Council the option to set an election either in November or within 120 days of receiving the proposed ordinance will save the City money while still allowing City Council the flexibility to schedule an earlier election on time-sensitive ordinances.
The ordinance has an emergency clause because the ordinance would not otherwise be effective in time to meet the ballot certification deadline set by the Secretary of State for the November 3, 2009 election, thereby resulting in the expense of a special election.
