AN ORDINANCE
SUBMITTING PROPOSED AMENDMENTS TO THE LAKEWOOD CITY CHARTER TO A VOTE OF THE REGISTERED ELECTORS OF THE CITY OF LAKEWOOD AT THE REGULAR MUNICIPAL ELECTION ON NOVEMBER 3, 2009; AND FURTHER DECLARING AN EMERGENCY
WHEREAS, the registered electors of the City of Lakewood adopted the Lakewood City Charter at the municipal election in 1983; and
WHEREAS, the City Council has determined that two amendments to the Charter are appropriate and necessary to modify certain provisions of the Charter; and
WHEREAS, pursuant to Section 14.9 of the Lakewood City Charter, Article XX of the Colorado Constitution and the provisions of the Colorado Revised Statutes, the City Council desires to adopt this ordinance in order to submit the proposed amendments to the Lakewood City Charter to a vote of the registered electors of the City of Lakewood at the regular municipal election on November 3, 2009.
NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of Lakewood, Colorado, that:
SECTION 1. The following proposed amendments to the Lakewood City Charter shall be submitted to the registered electors of the City of Lakewood at the regular municipal election on November 3, 2009:
PROPOSED CHARTER AMENDMENT NO. 1
Shall Article XIII, INITIATIVE PROCEDURES, Section 13.1 (d) of the Lakewood City Charter be amended to allow Lakewood City Council to either set a special election no later than 120 days from the day an initiative petition is presented to City Council or set the election date on the first Tuesday in November to be coordinated with Jefferson County?
If so amended, the provisions of Article XIII, Section 13.1 (d) shall read as follows:
(d) Within thirty days after the petition is presented by the City Clerk, the City Council shall either adopt the initiated ordinance by a majority vote of all members of City Council without any change to the initiated ordinance or submit the initiated ordinance to a vote of the registered electors of the City at a special election to be held within one-hundred twenty days, but not less than thirty days, after the petition is presented to the City Council or at a November coordinated election to held in conjunction with Jefferson County.

PROPOSED CHARTER AMENDMENT NO. 2
Shall Article XIII, REFERENDUM PROCEDURES, Section 13.2(e) of the Lakewood City Charter be amended to allow Lakewood City Council to either set a special election no later than 120 days from the day a referendum petition is presented to City Council or set the election date on the first Tuesday in November to be coordinated with Jefferson County?
If so amended, the provisions of Article XIII, Section 13.2 (e) shall read as follows:
(e) The City Council shall upon presentation of the referendum petition immediately reconsider the ordinance. If upon reconsideration the ordinance is not repealed in its entirety by a majority of all members of City Council, the ordinance shall be submitted, without amendment or alteration, to a vote of the registered electors at a special election to be held within one-hundred twenty days, but not less than thirty days, after presentation of the referendum petition to the City Council; or at a November coordinated election to held in conjunction with Jefferson County.

SECTION 2. The City Clerk shall take all actions necessary for such amendments to the Charter to be presented to the registered electors of the City of Lakewood at the regular municipal election on November 3, 2009.
SECTION 3. If a majority of the registered electors voting thereon vote for a proposed amendment, such amendment shall be deemed approved regardless of the vote on any other proposed amendment.
SECTION 4. Emergency: This ordinance is necessary for the immediate preservation of the public peace, health, or safety because delay in the effective date would prevent the question from being placed on the November ballot, resulting in the significant cost of a special election.
SECTION 5. Effective Date: This ordinance shall take effect immediately upon signature of the Mayor.
I hereby attest and certify that the within and foregoing ordinance was introduced and read on first reading at a regular meeting of the Lakewood City Council on the 27th day of July 2009; published by title in the Denver Post and in full on the City of Lakewood's website, www.lakewood.org., on the 30th day of July 2009; set for public hearing on the 10th day of August 2009; read, finally passed and adopted by the City Council on the ____ day of_________, 2009, and signed, and approved by the Mayor on the ________ day of _______, 2009.
