REQUEST FOR COUNCIL ACTION
ORDINANCE: O-2009-29
SUBJECT: Ordinance approving a major modification of the existing Lakewood West Official Development Plan to exclude Areas B and C, which are being added to the Red Rocks Business Park ODP by Ordinance O-2009-29. The major modification of the Lakewood West ODP would also increase the density in the remaining Area A to a maximum of 15 dwelling units per acre with a net density not to exceed 11 dwelling units per acre, and would clarify certain language to be consistent with current standards. In addition to incorporating Areas B and C, Ordinance O-2009-28 would add an R-1A (One Acre Residential) zoned parcel to the Red Rocks Business Park ODP to allow for a mix of retail, office, Agriburbiaä, and residential uses, and would rename the Red Rocks Business Park ODP the Solterra Centre ODP. Ordinance O-2009-30 seeks approval to vest the Solterra Centre ODP for a period of 25 years through the approval of a Development Agreement between the City and the property owners.

RECOMMENDATION: Staff recommends approval of Ordinance O-2009-29, making a major modification to the Lakewood West Official Development Plan, and specifically excluding Areas B and C from the Lakewood West ODP, increasing residential density in remaining Area A, and clarifying certain language. The Planning Commission by a vote of 5 to 0 at the June 3, 2009 meeting recommended approval of this request to City Council.
SUMMARY AND BACKGROUND OF SUBJECT MATTER: The applicant, on behalf of property owner CDN Red Rocks, L.P., seeks approval of: (1) a major modification of the Red Rocks Business Park ODP, including the incorporation of one R-1A parcel as well as Areas B and C from the Lakewood West ODP, with the newly modified ODP to be known as the Solterra Centre ODP; (2) a major modification of the Lakewood West ODP, and specifically the exclusion of Areas B and C, an increase in residential density in the remaining Area A, and to clarify certain language; and (3) a Development Agreement, establishing vested rights in the Solterra Centre ODP for a period of 25 years. O-2009-28, Solterra Centre ODP, and O-2009-29 are contingent upon one another. O-2009-30 is contingent upon approval of O-2009-28, Solterra Centre ODP the Site Specific Development Plan.
