AN ORDINANCE
TO MODIFY THE LAKEWOOD WEST OFFICIAL DEVELOPMENT PLAN (ODP) FOR LAND LOCATED AT 2301 SOUTH MCINTYRE STREET CITY OF LAKEWOOD, COUNTY OF JEFFERSON, STATE OF COLORADO
BE IT ORDAINED by the City Council of the City of Lakewood, Colorado, that:
SECTION 1. Upon application by Chris Bremner with Carma Lakewood, LLC for CDN Red Rocks L.P., in Lakewood Major Modification Case No. MO-09-001, and upon a recommendation of approval from the Lakewood Planning Commission, Lakewood Zoning Maps are hereby amended to include in the Planned Development Zone District (PD) the property described in Exhibit A attached hereto and made a part hereof.
SECTION 2. The Lakewood West Official Development Plan Modification No. 1 for the above-referenced land which has been recommended for APPROVAL by the City Planning Commission on June 3, 2009, is approved and accepted subject to minor revisions that may be required to conform to current City regulations.
SECTION 3. The Mayor and City Clerk are hereby authorized and directed to certify the within and foregoing approval and acceptance upon signing the Lakewood West Official Development Plan Modification No. 1. The City Clerk is hereby authorized and directed to file such Lakewood West Official Development Plan Modification No. 1 with the Clerk and Recorder of Jefferson County, together with a certified copy of this Ordinance attached thereto, pursuant to the effective date thereof, and upon satisfaction of the conditions for recording relating to the property described in Exhibit A.
SECTION 4. This Ordinance shall take effect forty-five (45) days after final publication.
I hereby attest and certify that the within and foregoing ordinance was introduced and read on first reading at a regular meeting of the Lakewood City Council on the 22nd day of June 2009; published by title in the Denver Post and in full on the City of Lakewood's website, www.lakewood.org., on the 25th day of June 2009; set for public hearing on the 13th day of July 2009; read, finally passed and adopted by the City Council on the 13th day of July, 2009, and signed, and approved by the Mayor on the 14th day of July, 2009.

LAKEWOOD WEST OFFICIAL DEVELOPMENT PLAN MODIFICATION NO. 1
AREA - A, LAKEWOOD WEST OFFICIAL DEVELOPMENT PLAN, the plat of which is recorded in ODP Book 33, Page 11, at Reception No. 83074563, of the records of the Jefferson County Clerk and Recorder, further lying in the Northwest One-Quarter (NW 1/4) of Section 25, Township 4 South, Range 70 West of the 6th Principal Meridian, City of Lakewood, County of Jefferson, State of Colorado, being more particularly described as follows:
Beginning at the Southwest corner of said NW1/4, said corner being in common with the Southwest corner of the Northeast One-Quarter (NE 1/4) of Section 26, said Township 4 South, Range 70 West; thence N 00°21'13" W along the West line of said MW 1/4 (Basis of bearing all other bearings herein related thereto), said last line being in common with the East line of said NE 1/4, a distance of 1,089.37 feet; thence S 89°56'25" W, a distance of 1,106.24 feet; thence N 20°52'46" W, a distance of 652.88 feet; thence N 32°10'23" W, a distance of 331.81 feet, more or less, to the North line of the South One-Half of the North One-Half of said NE 1/4; thence N 89°56'21" E along said North line, a distance of 1,510.11 feet, more or less, to the Northwest corner of the South One-Half of the North One-Half of said NW 1/4; thence N 89°24'18" E along said North line, a distance of 1,181.80 feet; thence S 00°21'13" E, a distance of 1,979.43 feet, more or less, to the South line of said NW 1/4; thence S 89°20'36" W along said South line, a distance of 1,181.81 feet, more or less, to the Point of Beginning;
