AN ORDINANCE

REPEALING CHAPTER 17-20 OF THE LAKEWOOD MUNICIPAL CODE TITLED ARTICLE 20: ROONEY VALLEY OVERLAY DISTRICT DEVELOPMENT STANDARDS.

WHEREAS, the Joint Project Review Committee (JPRC) adopted the Joint Rooney Valley Development Standards on March 10, 2009; and

WHEREAS, the Intergovernmental Agreement (IGA) between the Town of Morrison and City of Lakewood covers a majority of Lakewood properties within the Rooney Valley, except for the Tamarisk Subdivisions, municipally owned land south of West Alameda Parkway, and that portion of Robinson Brick property not within the IGA boundaries; and

WHEREAS, there are two sets of development standards overlaying City properties within the IGA boundary; and

WHEREAS, the property within the Springfield Green Official Development Plan (ODP) Modification No. 3 has also been included under the provisions of the Joint Rooney Valley Development Standards; and

WHEREAS, the properties within the Tamarisk Subdivisions are developed; and

WHEREAS, Robinson Brick owns the property south of West Alameda Parkway that is within Springfield Green Subdivision where they mine clay.  The underlying zoning is residential per the Springfield Green ODP; and

WHEREAS, Robinson Brick will be subject to the master plan requirement per note#18 of the Springfield Green Subdivision and will need to provide or adopt development standards through the master plan process at the time of development; and.

WHEREAS, Planning Case Number OA-09-001 was recommended for approval by the Lakewood Planning Commission on April 15, 2009 by a vote of 7 to 0.

NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of Lakewood, Colorado, that:

SECTION 1.  Article 20: Rooney Valley Overlay District Development Standards is repealed, Chapter 17-20 of the Lakewood Municipal Code.

SECTION 2.  This ordinance shall take effect thirty (30) days after final publication.

I hereby attest and certify that the within and foregoing ordinance was introduced and read on first reading at a regular meeting of the Lakewood City Council on the 8th day of June 2009; published by title in the Denver Post and in full on the City of Lakewood's website, www.lakewood.org., on the 11th day of June 2009; set for public hearing on the 22nd day of June 2009; read, finally passed and adopted by the City Council on the 22nd day of June, 2009, and signed, and approved by the Mayor on the 23rd day of June, 2009.
