REQUEST FOR COUNCIL ACTION
ORDINANCE: O-2009-24
SUBJECT: Ordinance accepting a Quitclaim Deed from the City and County of Denver to the City of Lakewood to clear title for the right-of-way for West Alameda Avenue within the City of Lakewood’s boundaries, and further accepting a Bargain and Sale Deed from the City and County of Denver to the City of Lakewood conveying three parcels of land for park and open space purposes. An emergency clause has been added to the Ordinance because conveyance of the right-of-way is necessary in order to preserve the schedule for the installation of the sanitary sewer line and water line facilities within the West Alameda Avenue right-of-way for the new St. Anthony Hospital.
ADDRESS: West Alameda Avenue between South Sheridan Boulevard and the southerly extended Westerly right-of-way line of Rooney Road West of C-470.
RECOMMENDATION: Staff recommends approval of this Ordinance accepting the conveyance of the West Alameda Avenue right-of-way by Quitclaim Deed, and the conveyance of the three parcels of land by Bargain and Sale Deed from the City and County of Denver.
SUMMARY AND BACKGROUND OF SUBJECT MATTER: The right-of-way for West Alameda Avenue through the City of Lakewood was initially acquired by the City and County of Denver for the purposes of having a public road from the Denver City limits to the Red Rocks Amphitheater. Denver also acquired three separate parcels that were intended for use as roadside parks along this section of West Alameda Avenue. Actual ownership of the right-of-way has become unclear over the years: the conveyance documents show that West Alameda Avenue is still under the ownership of the City and County of Denver, yet the Colorado Department of Transportation once quitclaimed any interests it may have had in the right-of-way to the City of Lakewood. In any event, it is clear that Lakewood has long had responsibility for maintaining the right-of-way, and all involved agree that the City should be the record owner of both the right-of-way and the three undeveloped parcels. Consequently, in recent years Lakewood staff has had discussions with the City and County of Denver regarding the conveyance of Denver’s interests in the right-of-way and three parcels to the City of Lakewood in order to clear title to the properties. Denver has now agreed to convey, at no cost to Lakewood, any interests it has in the right-of-way, to be used by Lakewood for public street purposes, and in the three parcels, which are limited to park and open space purposes. The three parcels are adjacent to existing Lakewood open space parks.
The Ordinance has an emergency clause because the conveyance needs to be completed so that sanitary sewer line and water line facilities needed to serve the new St. Anthony Hospital can be installed in the West Alameda Avenue right-of-way
