REQUEST FOR COUNCIL ACTION
ORDINANCE: O-2009-23
SUBJECT: Ordinance authorizing the execution of a Purchase and Sale Agreement between the City and County of Denver and the City of Lakewood to clear title for the right-of-way for West Alameda Avenue between Sheridan Boulevard westerly through the City of Lakewood to the southerly extended westerly right of way line of Rooney Road on the west side of Highway C-470, and the conveyance of three parcels of land for park and open space purposes to the City of Lakewood. In order to preserve the schedule for the installation of the sanitary sewer line and water line facilities within the West Alameda Avenue right-of-way necessary for the development of the Saint Anthony Hospital that is being built in the Denver Federal Center Development the Emergency Clause is necessary.
ADDRESS: West Alameda Avenue between South Sheridan Boulevard and the southerly extended Westerly right of way line of Rooney Road West of C-470.
RECOMMENDATION: Staff recommends approval of this ordinance authorizing the execution of the Purchase and Sale Agreement between the City and County of Denver and the City of Lakewood.

SUMMARY AND BACKGROUND OF SUBJECT MATTER: The right-of-way for West Alameda Avenue through the City of Lakewood was initially acquired by the City and County of Denver for the purposes of having a public road from the Denver City limits to the Red Rocks Amphitheater. Denver also acquired three separate parcels that would have been used as road side parks along this section of West Alameda Avenue. There is a cloud on the title to the right-of-way as to who actually has ownership to the right-of-way. By looking at the conveyance documents this right-of-way is still under the ownership of the City and County of Denver even though the Colorado Department of Transportation quitclaimed any interests they may have had in the right-of-way to the City of Lakewood. City of Lakewood staff has had discussions with the City and County of Denver to convey any interests they may have to the right-of-way and three parcels to the City of Lakewood. This conveyance would clear title to the right-of-way and the three parcels. Denver has agreed to convey, at no cost to the Lakewood, any interests they have in the right-of-way for public street purposes and the three parcels for park and open space purposes to the City of Lakewood. The reason for the Purchase and Sale Agreement is so that when Denver staff presents this proposal to the Denver City Council they have something in writing that is signed by the Lakewood agreeing the right-of-way will be used for public street purposes and the three parcels are for park and open space purposes. The three parcels are adjacent to existing Lakewood open space parks.
The ordinance has the emergency clause to allow the preservation of the schedule for the installation of the sanitary sewer line and water line facilities in the West Alameda Avenue right-of-way necessary for the Saint Anthony Hospital that is being built in the Denver Federal Center Development.
