AN ORDINANCE

REPEALING AND RE-ENACTING TITLE 16 OF THE LAKEWOOD MUNICIPAL CODE RELATING TO SUBDIVISION

WHEREAS, the City of Lakewood is authorized by C.R.S. § 31-23-102 et. seq.    and Article IX of the Lakewood Home Rule Charter to adopt regulations governing the subdivision of land; and

WHEREAS, the City previously adopted subdivision regulations, codified as Title 16 of the Lakewood Municipal Code (the “Subdivision Ordinance”); and

WHEREAS, while amendments have been made to Title 16 from time to time, the Subdivision Ordinance has not been comprehensively reviewed and updated for many years; and

WHEREAS, Michael J. Rock, City Manager for the City of Lakewood, has submitted an application to repeal and re-enact Title 16 of the Lakewood Municipal Code, the Subdivision Ordinance; and

Whereas, the Lakewood Planning Commission has reviewed the Subdivision Ordinance at a series of study sessions, interviewed development professionals, and received input from the public at two open houses held on February 3, 2009 and March 11, 2009, a Ward 1 meeting held on March 21, 2009, and a City Council study session on April 6, 2009; and

Whereas, as a result of the input received, the Lakewood Planning Commission has developed a number of improvements to the Subdivision Ordinance; and
Whereas, the proposed improvements to the Subdivision Ordinance, the Users’ Guide and Plat Specifications documents are consistent with the goals of the Comprehensive Plan; and

Whereas, the proposed changes to the Subdivision Ordinance, the Users’ Guide and Plat Specifications documents promote the health, safety or welfare of the inhabitants of the City and the purposes of this Ordinance.

NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of Lakewood, Colorado, that:

SECTION 1.  Title 16 of the Lakewood Municipal Code is repealed in its entirety and re-enacted as provided in the attached Subdivision Ordinance.

SECTION 2: This Ordinance shall take effect thirty (30) days after final publication.

I hereby attest and certify that the within and foregoing ordinance was introduced and read on first reading at a regular meeting of the Lakewood City Council on the 8th day of June 2009; published by title in the Denver Post and in full on the City of Lakewood's website, www.lakewood.org., on the 11th day of June 2009; set for public hearing on the 22nd day of June 2009; read, finally passed and adopted by the City Council on the 22nd day of June, 2009, and signed, and approved by the Mayor on the 23rd day of June, 2009.
