REQUEST FOR COUNCIL ACTION
ORDINANCE: O-2009-15
SUBJECT: Add Section 9.20.060 to Title 9 of the Lakewood Municipal Code pertaining to violation of bail bond conditions.
RECOMMENDATION: Mayor and City Council approve the proposed ordinance.
SUMMARY AND BACKGROUND OF SUBJECT MATTER:
The proposed new ordinance mirrors the language contained in the Colorado Criminal Code that makes it illegal to violate the conditions of a bail bond. The Police Department and the Municipal Prosecutors have requested that this provision be added to the Lakewood Municipal Code so that persons who violate the terms and conditions of a municipal bail bond may be prosecuted in Lakewood Municipal Court for such conduct. Such municipal bond conditions may prohibit the defendant from contacting witnesses or victims, order a defendant to stay away from the victim’s home or place of work, or prohibit possession or consumption of alcohol by the defendant. Other bail bond conditions may be imposed by the Municipal Court Judge depending upon the circumstances of the individual case.
