ORDINANCE: O-2009-11
SUBJECT: Amending the Liquor and Fermented Malt Beverages Ordinances regarding Manager Registrations to conform to State law.

RECOMMENDATION: Adoption of Ordinance
SUMMARY AND BACKGROUND OF SUBJECT MATTER: The Colorado Supreme Court has ruled that the subject of fermented malt beverage and alcoholic liquor beverages are matters of statewide concern. The City Code currently is in conflict with this ruling regarding the background investigations of managers of liquor and fermented malt beverage licensed establishments. This ordinance will amend the Municipal Code to allow for background investigations of managers of hotel & restaurant and tavern licenses only; which is consistent with the Court's ruling.
