AN ORDINANCE

REPEALING CHAPTER 2.03 OF THE LAKEWOOD MUNICIPAL CODE PERTAINING TO PERSONAL FINANCIAL DISCLOSURE STATEMENTS OF CANDIDATES AND ELECTED OFFICIALS

WHEREAS, C.R.S. §1-45-110 generally requires each candidate in a state election to file a Personal Financial Disclosure Statement; and

WHEREAS, the statute expressly provides that, in lieu of filing a Personal Financial Disclosure Statement, any candidate in a municipal election may comply with the statutory requirement by filing a Candidate Affidavit stating that he or she is familiar with § 1-45-110; and

WHEREAS, Chapter 2.03 of the Lakewood Municipal Code requires all candidates for City Council and Mayor to file Personal Financial Disclosure Statements, even though candidates in municipal elections are exempt from that requirement under state law; and

WHEREAS, the City Council of the City of Lakewood wishes to repeal Chapter 2.03 of the Lakewood Municipal Code in its entirety in order to conform to C.R.S. § 1-45-110.

NOW, THEREFORE, BE IT ORDAINED, by the City Council of the City of Lakewood, Colorado, that:

SECTION 1. Chapter 2.03 of the Lakewood Municipal Code is repealed in its entirety.

SECTION 2. This ordinance shall take effect thirty (30) days after final publication.

I hereby attest and certify that the within and foregoing ordinance was introduced and read on first reading at a regular meeting of the Lakewood City Council on the 9th day of February 2009; published by title in the Rocky Mountain News and in full on the City of Lakewood's website, www.lakewood.org., on the 12th day of February 2009; set for public hearing on the 23rd day of February 2009; read, finally passed and adopted by the City Council on the 23rd day of February, 2009, and signed, and approved by the Mayor on the 24th day of February, 2009.
