AN ORDINANCE

AMENDING THE LAKEWOOD ZONING ORDINANCE BY REPEALING THE EXISTING ARTICLE 19, THE WEST COLFAX AVENUE OVERLAY DISTRICT, AND REPLACING IT WITH THE NEW ARTICLE 19, THE COLFAX MIXED USE (CMU) ZONE DISTRICT.

WHEREAS, the City of Lakewood is a home rule city of the state of Colorado with full authority to legislate in matters of local concern such as zoning and land use matters; and

WHEREAS, Colfax Avenue is a major transportation and commercial corridor through the City; and

WHEREAS, the 2003 Lakewood Comprehensive Plan states that land use and development should be in compliance with the Plan; and

WHEREAS, the City of Lakewood has adopted the West Colfax Avenue Action Plan as an amendment to the City's Comprehensive Plan in 2005; and

WHEREAS, the West Colfax Avenue Action Plan is used to guide the future of West Colfax Avenue and includes implementation steps for the revitalization of the Corridor; and

WHEREAS, the City of Lakewood wishes to adopt the Colfax Mixed Use Zone District as an Action Plan implementation tool; and

WHEREAS, the West Colfax Avenue Land Use Regulations Focus Group was established to review the existing zoning along Colfax and recommend modifications and changes to the zoning pattern; and

WHEREAS, the Focus Group held 15 meetings and two open houses to develop the Colfax Mixed Use Zone District language; and

WHEREAS, the Planning Commission conducted a public hearing on November 19, 2008, and voted 6 to 0 to recommend the ordinance to the City Council; and

WHEREAS, it is necessary to make amendments to the Lakewood Zoning Ordinance to effectively adopt Colfax Mixed Use Zone District.

NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of Lakewood, Colorado, that:

SECTION 1. The City of Lakewood Zoning Ordinance is amended to repeal and replace Article 19 to create the Colfax Mixed Use (CMU) Zone District as attached as Attachment A.

SECTION 2. This ordinance shall take effect forty-five (45) days after final publication.

I hereby attest and certify that the within and foregoing ordinance was introduced and read on first reading at a regular meeting of the Lakewood City Council on the 12th day of January 2009; published by title in the Rocky Mountain News and in full on the City of Lakewood's website, www.lakewood.org., on the 15th day of January 2009; set for public hearing on the 26th day of January 2009; read, finally passed and adopted by the City Council on the 26th day of January, 2009, and signed, and approved by the Mayor on the 27th day of January 2009.
