ORDINANCE: O-2009-2

SUBJECT: Ordinance authorizing the City to convey a Permanent Easement for an existing sanitary sewer line and a Temporary Construction Easement to repair said sanitary sewer line to East Jefferson County Sanitation District across a portion of the Sloans Lake Greenbelt between Fenton Street and Eaton Street at approximately West 18th Avenue.

RECOMMENDATION: Staff recommends approval of this ordinance authorizing conveyance of the easements to East Jefferson County Sanitation District.

SUMMARY AND BACKGROUND OF SUBJECT MATTER: The City of Lakewood has been asked by East Jefferson County Sanitation District to convey a Permanent Easement for an existing sanitary sewer line which crosses the Sloans Lake Greenbelt between Fenton Street and Eaton Street at approximately West 18th Avenue. A Temporary Construction Easement is also needed in order to repair the sanitary sewer facility. The sanitary sewer line was constructed before the City of Lakewood was incorporated and for some unknown reasons the District never recorded or obtained an easement for this facility. It would be beneficial for both the City and the District to convey the easement to the District so the City will be assured that when the District does the construction to replace the sewer line all the City improvements consisting of sidewalk, lighting, sprinkler system and landscaping will be replaced after the construction. The repair of this sewer line is necessary to help better serve the adjoining neighborhood. Community Resources staff has reviewed this request and have no concerns.
