ORDINANCE: O-2009-1
SUBJECT: Ordinance authorizing the changing of the use of the westerly twenty-five (25.00) feet of Ray Ross Park, which consists of the east half of Harlan Street, from "open space and park purposes" to "public street purposes."
ADDRESS: 680 South Harlan Street.
RECOMMENDATION: Staff recommends approval of this ordinance authorizing the use changes.

SUMMARY AND BACKGROUND OF SUBJECT MATTER: Ray Ross Park was conveyed to the City of Lakewood in two parts by two different entities. The southern portion of the park was conveyed by Foothills Park and Recreation District as a result of the transfer of park and recreation properties and facilities to the City of Lakewood pursuant to the JOINT EXCLUSION PLAN AND AGREEMENT FOR DISPOSITION OF ASSETS AND CONTINUATION OF SERVICES, executed by the Foothills Park and Recreation District and the City of Lakewood. The northern portion was conveyed by the Jefferson County Board of County Commissioners for open space and park purposes. The Western most 25.00 feet of the park conveyance from the County, as described in the deed, is actually the eastern half of Harlan Street right-of-way, including utility facilities and street improvements. In other words, the deed from the County mistakenly restricted half of Harlan Street to open space and park uses. In order to correct the designation of that portion of Harlan Street to the right use, City Council must adopt an ordinance officially changing the use from "open space and park purposes" to "public street purposes." Changing the use will reflect the true status of the property as street right-of-way, allow the existing utility improvements and street improvements to remain, and allow the City and the public utility companies to install any additional facilities as needed in the future. Community Resources staff has reviewed this request and have no concerns.
