AN ORDINANCE
CHANGING THE USE FOR THE WESTERLY TWENTY-FIVE (25.00) FEET OF RAY ROSS PARK FROM "OPEN SPACE AND PARK PURPOSES" TO "PUBLIC STREET PURPOSES"
WHEREAS, Ray Ross Park was conveyed to the City of Lakewood by Foothills Park and Recreation District as a result of the transfer of park and recreation properties and facilities to the City of Lakewood pursuant to the JOINT EXCLUSION PLAN AND AGREEMENT FOR DISPOSITION OF ASSETS AND CONTINUATION OF SERVICES, executed by the Foothills Park and Recreation District and the City of Lakewood and by the Jefferson County Board of County Commissioners for open space and park purposes; and
WHEREAS, the West 25.00 feet of the park conveyance is actually being used as the east half of Harlan Street right-of-way, which includes utility facilities and street improvements; and
WHEREAS, the open space and park uses described in Exhibit A, attached hereto and made a part hereof, should be changed to public street purposes.
NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of Lakewood, that:
SECTION 1. The use of that portion of the Ray Ross Park described in Exhibit A shall be changed from "open space and park purposes" to "public street purposes".
SECTION 2. This ordinance shall take effect thirty (30) days after final publication.
I hereby attest and certify that the within and foregoing ordinance was introduced and read on first reading at a regular meeting of the Lakewood City Council on the 12th day of January 2009; published by title in the Rocky Mountain News and in full on the City of Lakewood's website, www.lakewood.org., on the 15th day of January 2009; set for public hearing on the 26th day of January 2009; read, finally passed and adopted by the City Council on the 26th day of January, 2009, and signed, and approved by the Mayor on the 27th day of Janaury 2009.

Exhibit "A"
Two parcels of land being the West 25.00 feet of that tract of land conveyed to the City of land described in that Commissioner's Deed recorded at Reception Number F0987181, of the records of the Jefferson County Clerk and Recorder and lying in Section 13, Township 4 South, Range 69 West of the Sixth Principal Meridian, City of Lakewood, County of Jefferson, State of Colorado, more particularly described as follows:
The West twenty-five feet of the West One-half (W½) of the South Ten (10) acres of the Southwest One-quarter (SW¼) of the Northeast One-quarter (NE¼) of said Section 13; TOGETHER WITH that part of said SW¼ NE¼ described as follows:
Beginning at the Northwest corner of the South 10 acres of said SW¼ NE¼; thence northerly along the West line of said SW¼ NE¼, a distance of 196.4 feet; thence easterly along a line parallel with the North line of said South 10 acres, a distance 25.00 feet; thence southerly along a line parallel with and 25.00 feet easterly of said last West line, a distance of 196.4 feet, more or less, to a point on the North line of said South 10 acres; thence westerly along said last North line, a distance of 25.00 feet, more or less, to the point of Beginning; FURTHER TOGETHER WITH the following described parcel described as follows:
A parcel of land lying being the West 25.00 feet tract of land conveyed to the City of Lakewood described in that Special Warranty Deed recorded at Reception Number F0795757, of the Jefferson County Clerk and Recorders records and further lying in the Southeast One-quarter (SE¼) of Section 13, Township 4 South, Range 69 West of the Sixth Principal Meridian, City of Lakewood, County of Jefferson, State of Colorado, more particularly described as follows:
The West 25.00 feet of Block 8, JEFFERSON GARDENS, the plat of which is recorded in Plat Book 1, at Page 32A, of the records of the Jefferson County Clerk and Recorder EXCEPT the South 361.16 feet thereof.
The foregoing legal descriptions were prepared by Ted Van Horn on April 8, 2008, City of Lakewood, Property Management Division, 480 South Allison Parkway, Lakewood, Colorado 80226-3127. This was based on the above referenced Deeds and the recorded plat of said JEFFERSON GARDENS.
