REGULAR MEETING OF
LAKEWOOD LIQUOR AND FERMENTED MALT BEVERAGE
LICENSING AUTHORITY
October 8, 2009
A Regular Meeting of the Lakewood Liquor and Fermented Malt Beverage Licensing Authority was held on this date in the City Council Chambers.
ITEM 1 – CALL TO ORDER
Hearing Officer Richard Miller called the meeting to order at 2:21 p.m.
ITEM 2 – APPLICATION
Hotel & Restaurant License
Villa Alameda, LLC
d/b/a Parrilla De Jimmy Steakhouse
6026 W. Alameda Ave.
Robert Dill, Registration No. 5725, stated he was appearing on behalf of the applicant.
Michelle Kline, attorney for the City of Lakewood, stated that the City had no objections to the license being issued and that a background investigation had been completed by the Lakewood Police Department and was recommending approval of the liquor license.
Jim Nixon, 6242 Pierson Ct., Arvada, CO 80004, was sworn in and stated that he was the manager of Parrilla De Jimmy Steakhouse. Mr. Nixon stated his experience in the restaurant business. Mr. Nixon stated that there was a liquor license previously at this location under the name of Villa Del Sol and that Mr. Felipe Duran was the owner of that business and is the owner of Parrilla De Jimmy Steakhouse. Mr. Nixon explained that Mr. Duran had sold Villa Del Sol and that the new owner failed to follow through with the liquor license application. Mr. Nixon stated the training that the employees would undergo for the sale of alcohol.
In answer to Mr. Miller’s question, Mr. Dill stated that Mr. Duran had sold Villa Del Sol to a third party and the third party had applied and received a temporary permit. Mr. Dill stated that in the mean time, the underlying liquor license had expired because it was not renewed, anticipating the sale would be completed. Mr. Dill stated that the third party did not follow through and the temporary permit expired. Mr. Dill stated that
Mr. Duran was the sole owner of the corporation and that he had interests in a variety of restaurants.
Kelly Pietrs, 2792 S. Race St, Denver, C 80210, was sworn in and stated that she was the owner of Esquire Petitioning Services, LLC and was retained to do the petitioning for Villa Alameda, LLC. Ms. Pietrs stated the procedures used to do the petitions and explained the results of the survey.
In answer to Mr. Miller’s question, Mr. Nixon stated that Mr. Duran had decided to change the name and concept of the restaurant because of the way the third party had operated the business, and that Mr. Duran thought that it was best to start fresh with a new name.
Mr. Miller having found that all of the requirements for a Hotel & Restaurant License had been satisfied, approved the application for a Hotel & Restaurant License for Villa Alameda, LLC, d/b/a Parrilla De Jimmy Steakhouse, located at 6026 W. Alameda Ave.
ITEM 3 – APPLICATION
3.2% Fermented Malt Beverage On Premises License
NPC International, Inc.
d/b/a Pizza Hut #4853
45 Union Blvd.
Katherine Gallardo, 691 S. Simms St., Lakewood, CO 80228, was sworn in and stated she was the manager of the Pizza Hut at 45 Union Blvd.
Connie Spinden, 6745 W. 96th Ct., Westminster, CO 80021, was sworn in and stated she was the area coach for NPC International, Inc.
Ms. Kline stated that the Lakewood Police Department was recommending approval of the liquor license.
Ms. Gallardo stated that the restaurant had been a corporate restaurant owned by
Pizza Hut, Incorporated and was bought by NPC International, Inc. on January 20, 2009. Ms. Gallardo stated that the restaurant had originally had a 3.2% Fermented Malt Beverage License but had not had a liquor license since switching over to NPC International, Inc. and that they were now applying for the liquor license again.
Ms. Gallardo stated her experience regarding the sale of alcohol. Ms. Gallardo stated NPC International, Inc.’s training program regarding the sale of alcohol.
Ms. Spinden stated that through the agreement of the sale with Pizza Hut, Inc.,
NPC had to forfeit the liquor license. Ms. Spinden stated that they were formerly a Pizza Hut corporate restaurant and that a franchise group bought out the Pizza Hut restaurants in the entire Denver Metro Area. Ms. Spinden stated that NPC had been trying for the last six months to get the liquor licenses back. Ms. Spinden stated there were 55 locations in Denver and that she oversaw eight locations.

ITEM 4 – GENERAL BUSINESS
There was no general business to be discussed.
ITEM 5 – ADJOURNMENT
There being no further business to come before the Authority, Richard Miller adjourned the meeting at 2:57 p.m.
