Citizen Initiated Ordinance

A CITIZEN-INITIATED ORDINANCE

Whereas unlicensed drivers are ineligible for liability auto insurance and pose a significant danger to the people of the City of Lakewood when driving and must be prevented from doing so in every way possible.

 a. The Chief of Police and their designees shall be required to immediately impound a vehicle driven in violation of this section. It is hereby requested that all other traffic enforcement officers conform with these provisions when in the City of Lakewood. When the driver of a vehicle is driving without an operator's license or chauffeur's license which is current and valid, or when the driver does not have such license in the driver's immediate possession, or when the driver drives a vehicle contrary to restrictions imposed upon the license, or when the driver drives a vehicle while their operator's or chauffeur's license has been denied, suspended, canceled or revoked by the state, the vehicle driven shall be immediately impounded. A vehicle driver who has a valid state driver's license of record but not in their immediate possession or a vehicle driver who presents an expired state license that is eligible for renewal may, at the discretion of the attending police officer, be issued a summons for driving without a license without impounding the vehicle when such driver has convincing corroborating identification and proof of vehicle insurance. Such summons along with proof of a valid drivers license shall be submitted within ten working days in a manner to be determined by the City for validation or such vehicle shall be ordered impounded.
 
 b. The release of a motor vehicle impounded as provided in this ordinance shall require that A two-thousand five-hundred dollar bond be posted within thirty days of impoundment in favor of the City of Lakewood or the motor vehicle is subject to disposal by the city by auction or otherwise. This Bond shall be held for a period of one year and forfeited if such vehicle is operated by an unlicensed driver in Colorado within that time. For this section a two-hundred dollar impoundment land acquisition fee shall be paid to the City prior to the release of vehicle. These requirements are not applied when the operator of such vehicle is found to have had a valid drivers license, or when an expired State license has been renewed within thirty days of towing, or when such vehicle  has been reported stolen to the police when ascertained, or when such vehicle is owned and rented out by a licensed rental car company, with such vehicle being released upon payment of towing and impoundment charges.
 
c. Legislation may be enacted to facilitate the operation of this ordinance by the Mayor and City Council but in no way shall such legislation limit or restrict the provisions of this section or the powers herein granted.
