A RESOLUTION

AUTHORIZING AMENDMENT OF THE CITY MANAGER DEFINED BENEFIT PENSION PLAN AND TRUST FOR THE CITY OF LAKEWOOD BY ADOPTION OF THE FOURTH AMENDMENT

WHEREAS, the amended and restated City Manager Defined Benefit Pension Plan for the City of Lakewood (the "City Manager Plan") was adopted by the City Council, effective April 1, 2000; and

WHEREAS, the Lakewood City Council desires to amend the City Manager Plan by the Fourth Amendment thereto, in order to provide for certain mandatory technical tax law changes contained in the final Treasury Regulations under Internal Revenue Code Section 415, effective as of January 1, 2008.

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Lakewood, Colorado, that the City Manager Plan is amended by the adoption of the Fourth Amendment, effective as of January 1, 2008, in the form attached hereto as Exhibit "A".

INTRODUCED, READ AND ADOPTED by a vote of 11 for and 0 against at a regular meeting of the City Council on December 8, 2008, at 7 o'clock p.m. at the Lakewood Civic Center, 480 South Allison Parkway, Lakewood, Colorado.
