RESOLUTION: 2008-75
SUBJECT: Amendment to an agreement regarding improvements to 7th Avenue, 8th Avenue and Fig Street.
RECOMMENDATION: Approval
FUNDING SOURCE: Lena Gulch Metropolitan District.
SUMMARY AND BACKGROUND OF SUBJECT MATTER:
In 2003 a decision was made to close a portion of 8th Avenue from approximately Fig Street to Indiana Street. An agreement was executed among Jefferson County, the Lena Gulch Metropolitan District and the City of Lakewood to reconstruct Fig Street and realign the intersections of Fig with 7th Avenue and with 8th Avenue. Eighth Avenue is in Lakewood, 7th and Fig are in unincorporated Jefferson County. The agreement identified two phases of construction. The first phase was completed several years ago. The second phase has not been constructed.
The 2003 agreement called for the second phase of construction to have been completed in 2005. The 2005 date was established based on assumed development schedules for properties east of Indiana and between 6th Avenue and 8th Avenue. The market has not supported the assumed development schedules. Consequently, the traffic volumes on the three streets have not increased as quickly as originally anticipated and the second phase improvements are not yet needed and have been deferred. The second phase of improvements will include additional roadway width and sidewalks. Constructing the second phase of improvements now would require acquisition of property from up to 15 parcels.
This proposed amendment to the 2003 agreement retains the obligation of the Lena Gulch Metropolitan District to complete phase two of the improvements. The purpose of the amendment is to tie the timing of Phase Two construction to traffic conditions that would warrant the improvements rather than to a specific date. Three triggers are included in the amendment that would cause the phase 2 improvements to be constructed. They are:
- Redevelopment of properties adjacent to the planned street improvements,
- An increase of through traffic volumes to the level that was originally
projected, or
- An increase in the combination of through and turning traffic that
would warrant a left turn lane.
As each of the triggers occurs, a portion or all of the phase 2 improvements
will be constructed as necessary to serve the relevant traffic.
