A RESOLUTION
AUTHORIZING AN AMENDMENT TO THE 2003 AGREEMENT AMONG THE LENA GULCH METROPOLITAN DISTRICT, JEFFERSON COUNTY AND THE CITY OF LAKEWOOD REGARDING 7TH AVENUE, 8TH AVENUE AND FIG STREET
WHEREAS, in 2003 the City of Lakewood ("City") entered into an agreement with the Lena Gulch Metropolitan District ("District") and Jefferson County ("County") that defined the scope and timing of certain improvements to be constructed related to 7th Avenue, 8th Avenue and Fig Street; and
WHEREAS, said agreement anticipated that development of properties in the vicinity would occur more quickly than has been experienced; and
WHEREAS, because development has not occurred as quickly as anticipated traffic conditions do not warrant completing the improvements in the timeframe identified in the agreement; and
WHEREAS, to complete the improvements now would require acquisition of property from an estimated 15 parcels; and
WHEREAS, the City, District and County agree that the 2003 Agreement must be amended to modify the timing of completion of the improvements to reflect actual traffic conditions and adjacent property development.
NOW, THEREFORE, BE IT RESOLVED by the City Council of Lakewood, Colorado, that:
SECTION 1. The City Council hereby finds that the 2003 Intergovernmental Agreement among the City, Town and District should be amended to require completion of the roadway improvements at the time adjacent land development or traffic conditions warrant said construction.
SECTION 2. The City Manager is authorized to execute, and the City Clerk to
attest, an amendment to the 2003 Agreement among the County, District and City,
in a form approved by the City Attorney, that reflects required completion of
the roadway improvements when warranted.
INTRODUCED, READ AND ADOPTED by a vote of 11 for and 0 against at a regular meeting of the City Council December 8, 2008, at 7 o'clock p.m. at Lakewood Civic Center, 480 South Allison Parkway, Lakewood, Colorado.
