RECOMMENDATION: Adoption of resolution 2008-68 in support of State Ballot Referendum "O"

SUMMARY AND BACKGROUND OF SUBJECT MATTER:
The City Council Legislative Committee and Mayor Bob Murphy met in August to review and study all statewide ballot issues that are before voters this fall. While it is generally the practice of the City Council to not support or oppose statewide ballot issues, the Committee felt that an exception was in order on this particular issue.
Referendum "O" would protect, and make easier, citizens' right to petition an item onto the ballot for a change in State Statutes. At the same time, Referendum "O" protects the sanctity of the State Constitution by making it more difficult to petition changes that should better be addressed in Statute.
Because it has been just as easy to amend Colorado's Constitution as it has
been to change State laws through ballot issues, the Constitution has become
cluttered with
routine lawmaking as opposed to serving a guiding document that outlines the
organization and powers of the State of Colorado.
Referendum "O" would reduce the number of voter signatures needed to put an item on the ballot to change State law but would increase the numbers needed to put an item on the ballot to change the State Constitution. This change preserves voter rights and preserves the sanctity of the Constitution.
Referendum "O" would have no impact on City ballot issues or ordinances.
