RFCA- R-2008-60 REQUEST FOR COUNCIL ACTION

RESOLUTION: 2008-60

SUBJECT: Authorizing an Intergovernmental Agreement with the Urban Drainage and Flood Control District (UDFCD) to reimburse the City of Lakewood for a portion of the cost of acquiring the property at 1290 Harlan Street.

RECOMMENDATION: Approval

SUMMARY AND BACKGROUND OF SUBJECT MATTER: The City's acquisition of the property at 1290 Harlan Street is complete. As part of the West Corridor Light Rail project, the Regional Transportation District will construct a channel for Dry Gulch across the northern portion of 1290 Harlan. Regardless of future ownership and uses at 1290 Harlan, a permanent drainage easement for the channel will be retained by the City to allow maintenance of the channel by the City or the Urban Drainage and Flood Control District.

UDFCD has agreed to reimburse the City for 50% of the value of the permanent easement. An appraisal of the permanent easement has been completed and the reimbursement will be approximately $50,000.
