A RESOLUTION
APPROVING AN INTERGOVERNMENTAL AGREEMENT WITH THE URBAN DRAINAGE AND FLOOD CONTROL DISTRICT FOR PARTIAL REIMBUSEMENT OF THE VALUE OF A DRAINAGE EASEMENT AT 1290 HARLAN STREET FOR DRAINAGE IMPROVEMENTS TO DRY GULCH
WHEREAS, the City of Lakewood's Stormwater Management Utility and the Urban Drainage and Flood Control District fund capital improvement projects and the acquisition of easements for those projects; and
WHEREAS, the City has purchased the property at 1290 Harlan Street; and
WHEREAS, the Regional Transportation District (RTD) is currently in the process of final design of improvements to Dry Gulch across this property as part of the West Corridor Light Rail project; and
WHEREAS, RTD intends to construct improvements to Dry Gulch within a drainage easement on the 1290 Harlan Street property; and
WHEREAS, the Urban Drainage and Flood Control District (UDFCD) and the City of Lakewood would like to enter into an intergovernmental agreement for UDFCD to reimburse the City for a portion of the value of a drainage easement on property located at 1290 Harlan Street.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Lakewood, Colorado, that:
SECTION 1. The City Manager is hereby authorized to execute and the City Clerk
to attest to an intergovernmental agreement with UDFCD to reimburse the City
for a portion of the value of a drainage easement at 1290 Harlan Street, in
form approved by the City Attorney, the amount of reimbursement from UDFCD shall
not exceed Fifty Thousand and No/100 Dollars ($50,000).
INTRODUCED, READ AND ADOPTED by a vote of 9 for and 0 against (Doug Anderson
reclused himself) at a regular meeting of the City Council on September 8, 2008,
at 7 o'clock p.m. at Lakewood Civic Center, 480 South Allison Parkway, Lakewood,
Colorado.
