A RESOLUTION

AUTHORIZING THE CITY OF LAKEWOOD TO ENTER INTO A REVOCABLE LICENSE AGREEMENT WITH THE FOSSIL RIDGE METROPOLITAN DISTRICT NO. 1 FOR THE INSTALLATION AND MAINTENANCE OF A SOLAR ARRAY ON CITY PROPERTY WITHIN FORSBERG IRON SPRING PARK AND IN THE RIGHT-OF-WAY FOR WEST EVANS AVENUE

WHEREAS, Fossil Ridge Metropolitan District No. 1 has requested a revocable license agreement from the City of Lakewood to allow the installation of a solar panel array on a portion of the City's Forsberg Iron Spring Park and in the adjacent right-of-way for West Evans Avenue; and

WHEREAS, the City is willing to allow the use of the City property for said purpose in accordance with the terms and conditions of a revocable license agreement issued by the City; and

WHEREAS, the City Charter authorizes the City to permit the installation of utility facilities in or on City parkland.

NOW, THEREFORE, BE IT RESOLVED by the City Council of Lakewood, Colorado, that:

SECTION 1. The City Manager is hereby authorized to execute, and the City Clerk to attest, a revocable license agreement between the City of Lakewood and the Fossil Ridge Metropolitan District No. 1 in a form approved by the City Attorney, for the use described above of the City-owned property described in Exhibit A to the revocable license agreement.

INTRODUCED, READ AND ADOPTED by a vote of ____ for and ____ against at a regular meeting of the City Council on July 28, 2008, at 7 o'clock p.m. at Lakewood Civic Center South, 480 South Allison Parkway, Lakewood, Colorado.
