RESOLUTION: 2008-46
SUBJECT: Memorandum of Agreement (MOA) between the City of Lakewood and the State of Colorado regarding elevators
RECOMMENDATION: Approval
SUMMARY AND BACKGROUND OF SUBJECT MATTER: Currently the City of Lakewood performs all plan review and inspection of elevators. The word "elevator" is used generically herein to refer to elevators, escalators, people movers, and similar facilities. The MOA and attached resolution use the term "conveyances." Last year, the Colorado General Assembly created statewide elevator regulations. All jurisdictions that are performing elevator inspections must now either (a) be registered with the State and sign a Memorandum of Agreement or (b) rely on the State for regulation of all elevators. Entering into the MOA would authorize the City to continue with its current elevator program.
The MOA, as negotiated, primarily requires Lakewood to:
Regulate elevators using codes that are consistent with the codes adopted by the State. Lakewood's current code is consistent with the State's. In general terms, the code requires that Lakewood:
o Retain design and installation records regarding all elevators within Lakewood.
o Review plans, issue permits, and perform the required inspections for installation of new elevators.
o Annually inspect each elevator installation and retain inspection records.
Provide to the State, and annually update, a list of all elevators located within Lakewood.
The City currently provides all of the services listed above. The MOA will
not create any new work or expense for contractors or owners. The City's elevator
inspector will need to be certified by an approved entity by July 2010.
By entering into the MOA, the City will continue to provide coordinated plan review and inspection of elevators and the buildings in which they are installed. Without the MOA, the City would continue to provide plan review and inspection of the buildings and the State would begin providing plan review and inspection of the elevators. Without the MOA the potential may arise that State and City plan review or inspection comments may be incompatible or may be received at different times reducing the efficiency of the building process.
