RESOLUTION: 2008-40

SUBJECT: Establishing a procedure for removal by the City Council of members of the City's Boards and Commission for cause.

RECOMMENDATION: Adopt the resolution.

SUMMARY AND BACKGROUND OF SUBJECT MATTER: The boards and commissions for the City of Lakewood are an essential component of Lakewood City Government. Members serve very specific roles as representatives of the City and each is interviewed and appointed by the City Council. Yet, a method for removal of an appointee has never before been established.

While it is rare, there potentially could be occasions where an appointed board or commission member would become incapable of performing their duties, no longer meet the qualifications for the position, or engage in conduct or activities that may be harmful to the City, its citizens, or a particular board or commission.

One of the first tasks assigned, by City Council officers, to the newly formed Commission for an Inclusive Community was to study and propose such a method for removal, should it become necessary. The Executive Committee of the Commission worked closely with the City Attorney's Office, and researched best practices of other communities, and has developed a recommended procedure.

The recommendation was presented to the City Council Officers, who approved its presentation to the entire City Council. It is presented here in the form of the attached resolution.
