A RESOLUTION

ESTABLISHING A PROCEDURE FOR REMOVAL BY THE CITY COUNCIL OF MEMBERS OF THE CITY'S BOARDS AND COMMISSIONS FOR CAUSE

WHEREAS, the boards and commissions of the City of Lakewood are an essential component of Lakewood city government; and

WHEREAS, the City Council appoints the members of the City's boards and commissions; and

WHEREAS, it is essential that the City establish a procedure for removal of members of boards and commissions in the event that members become incapable of performing their duties, no longer meet the qualifications for the position, or engage in conduct or activities that may be harmful to the City or the particular board or commission.

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Lakewood, that:

SECTION 1. The City Council shall have the authority to remove members of any of the City's boards and commissions for the following reasons:

A. Physical or mental disability rendering the board or commission member unable to perform his or her duties;

B. Excessive unexcused absence from board or commission meetings, including but not limited to three consecutive absences from regular board or commission meetings or study sessions;

C. Knowing disclosure of confidential information, which is defined to mean information which is not available to the general public under applicable laws, ordinances and regulations, and which is obtained by reason of the board or commission member's position with the City;

D. Failure to maintain the qualifications of a board or commission member for the board or commission on which the member serves;

E. Unreasonably disrupting or interfering with the conduct of any meeting of a board or commission;

F. A felony conviction while serving on a board or commission.

SECTION 2. The procedure for removal of a member of a City board or commission shall be as follows:

A. A board or commission member, or in the case of the Advisory Commission For An Inclusive Community, its Executive Committee, may present grounds for removal of a member to the City Council Screening Committee;

B. After review, the Screening Committee shall make a determination as to whether removal is warranted;

C. If evidence so warrants, a resolution for removal will be presented to the City Council for a vote. The City Council shall by majority vote determine if the member should be removed;

D. The member shall be provided written notice of the grounds for removal and the time and place of the City Council's action on the removal, at which time the member may address the City Council regarding the grounds for removal.

E. A member may resign from a board or commission at any time by providing a written resignation letter to the City Clerk or, in the case of the Advisory Commission For An Inclusive Community, by providing a written resignation letter to the Advisor Coordinator for the Advisory Commission For An Inclusive Community.

INTRODUCED, READ AND ADOPTED by a vote of 9 for and 1 against at a regular meeting of the City Council on May 12, 2008 at 7 o'clock p.m. at Lakewood Civic Center, 480 South Allison Parkway, Lakewood, Colorado.
