RFCA R-2008-29 REQUEST FOR COUNCIL ACTION

RESOLUTION: 2008-29

SUBJECT: Acquisition by the Regional Transportation District (RTD) of private property for the purposes of the West Corridor Light Rail Project.

RECOMMENDATION: Approval

SUMMARY AND BACKGROUND OF SUBJECT MATTER: Mayor Murphy has initiated this resolution as a means to impress upon the Regional Transportation District (RTD) the importance of treating Lakewood homeowners and businesses fairly and with openness during the acquisition and construction phases of buildout of the West Corridor Light Rail Line.

While both officials and residents of Lakewood understand that disruption is inevitable during the construction of such a large project through our city, the Mayor and City Council want to express as strongly as possible that RTD should take only what property is absolutely necessary for the rail lines, stations and parking and that any potential impact to property owners should be communicated as early as possible with those property owners. In addition, RTD should seek first to negotiate in good faith with the property owner for fair compensation of the property needed and only use eminent domain as a last result.
