SUBJECT: Utility Relocation Agreement with the Regional Transportation District (RTD).

RECOMMENDATION: Approval

SUMMARY AND BACKGROUND OF SUBJECT MATTER:

The City of Lakewood owns and operates water and sanitary sewer facilities within portions of the West Corridor Light Rail Transit (LRT) Project. Several sections of Lakewood's water and sanitary sewer facilities have been identified as being in conflict with proposed LRT construction.

This Utility Relocation Agreement documents the agreement between Lakewood and RTD defining cost responsibilities and outlining who will perform the necessary utility relocation in a timely manner as to not delay LRT construction. This agreement is a standard agreement that RTD has used for all utility owners with facilities in the West Corridor LRT project area.

A summary of the key agreement components follows:

1. Covers relocation of City owned water and sewer facilities necessitated by the West Corridor project.

2. RTD is reimbursing the water utility for all relocation work required because the facilities are in City-owned right-of-way (ROW). This work is not an improvement previously identified by the water utility. Cost at this time is unknown.

3. The sewer utility has planned to replace a sewer line in 13th Ave from Balsam to Lamar because the line is in poor condition. This section is in City-owned ROW and the City has been credited $1,854,000 against Lakewood's local share match for the West Corridor project.

4. RTD is reimbursing the sewer utility for all relocation work required between Lamar and Harlan Street because the facilities are in City-owned ROW or easements. Reimbursement to the sewer utility will be based on actual construction costs from competitive bids. Cost at this time is unknown. This work is required solely for the benefit of the West Corridor project and was not an improvement previously identified by the sewer utility.

5. Five sewer crossings of RTD-owned ROW and two segments of sewer pipe in RTD-owned ROW need to be replaced or relocated. RTD's contractor will perform this work. The cost will be borne by the sewer utility and there will be no credit for this work toward Lakewood's local share match because the utility facilities are in RTD-owned ROW. Reimbursement to RTD will be based on actual construction costs from competitive bids. At this time is the work is estimated to cost $175,000 to $200,000. The Lakewood Sewer Utility Enterprise Fund has adequate funds to pay for these costs.
