A RESOLUTION

AUTHORIZING A UTILITY RELOCATION AGREEMENT (URA) WITH THE REGIONAL TRANSPORTATION DISTRICT (RTD) FOR CITY OF LAKEWOOD (LAKEWOOD) OWNED UTILITY FACILITIES IMPACTED BY RTD'S WEST CORRIDOR LIGHT RAIL TRANSIT (LRT) PROJECT

WHEREAS, RTD and Lakewood desire to cooperate for the purpose of ensuring that the relocations of all Lakewood-owned utilities that are required to accommodate the West Corridor LRT Project are promptly performed in close coordination with RTD's Contractor; and

WHEREAS, RTD and Lakewood plan to issue Work Orders to identify the Party responsible to perform the utility work in conjunction and coordination with the performance of the West Corridor LRT Project work so as to ensure timely completion; and

WHEREAS, RTD and Lakewood desire to enter into this URA, which contains terms and conditions applicable to such coordination and to the performance of all such utility work.

NOW, THEREFORE, BE IT RESOLVED by the City Council of Lakewood, Colorado, that:

SECTION 1. The City Manager is hereby authorized to execute, and the City Clerk to attest, a Utility Relocation Agreement with the Regional Transportation District, in form approved by the City Attorney, for relocating City of Lakewood owned utilities on the West Corridor LRT Project.

INTRODUCED, READ AND ADOPTED by a vote of 9 for and 2 against at a regular meeting of the City Council on February 11, 2008, at 7 o'clock p.m. at Lakewood Civic Center, 480 South Allison Parkway, Lakewood, Colorado.
