RESOLUTION: 2008-27
SUBJECT: Maintenance Agreement with the Fossil Ridge Metropolitan District for certain improvements associated with the Solterra development.
RECOMMENDATION: Approval.
FUNDING SOURCE: City and Fossil Ridge Metropolitan District.
SUMMARY AND BACKGROUND OF SUBJECT MATTER: The proposed agreement describes maintenance responsibilities for several facilities that will be required for or incorporated in the Solterra project in the Rooney Valley. Generally, facilities proposed by the developer to upgrade the neighborhood will be maintained by the District. All of the improvements listed below will be installed at no City cost.
A summary of key agreement components follows and a map of some of the facilities is attached to the agreement as Exhibit A:
1. Open space maintenance including plant material, irrigation and trails/sidewalks:
a. The District will maintain the landscape along the collector and arterial streets except Alameda, which will be maintained by the City. Alameda is separated from the Solterra project by more than 600'. Landscape along Alameda will appear to be part of the City's park and other properties that front on Alameda. The City will maintain the walks along public streets.
b. The City will maintain landscaping and trails in the three north-south publicly owned open space corridors and Forsberg Iron Spring Park after an initial multi-year grow-in period during which the District will provide maintenance. Providing these areas is a component of the City's master plan for the Rooney Valley.
c. Lakewood will maintain landscaping and trails in the City owned dog park.
d. The developer is creating a number of other open space corridors that the District will maintain.
2. The City will maintain public street pavements. Special paving will be used for some crosswalks and these will be maintained by the District.
3. The District will remove snow from walks along collector streets. Walks
along arterial and local public streets and in the open space corridors will
be cleared pursuant to City policy.
4. Homeowners along each private street, through their homeowner associations,
will be responsible for street and sidewalk maintenance including snow removal.
5. The District will maintain special architectural features. At this time it is anticipated that special features may include unique street signs, entry features, box culvert facing materials, and streetlights.
This agreement is proposed for approval at this time because homes are under construction and approximately 90 lots have been platted. Plats proposing more than 200 additional lots are currently being reviewed. However, it is recognized that this project will require several years for planning to be completed and several more years for complete build-out. Therefore, amendments to the agreement may be necessary to add land or improvements to the agreement or to amend the agreement to conform with final design decisions. The agreement does authorize the City Manager to amend the agreement as necessitated by final design decisions.
