A RESOLUTION
AUTHORIZING THE CITY MANAGER TO ENTER INTO AN AGREEMENT WITH THE FOSSIL RIDGE METROPOLITAN DISTRICT NO. 1 RELATING TO MAINTENANCE
WHEREAS, the Solterra development in the Rooney Valley includes facilities and improvements unique within the City of Lakewood (City); and,
WHEREAS, the City and the Fossil Ridge Metropolitan District No. 1 agree that coordinated maintenance of facilities associated with the Solterra project is desirable.
NOW, THEREFORE, BE IT RESOLVED by the City Council of Lakewood, Colorado, that:
SECTION 1. The City Manager is hereby authorized to execute and the City Clerk attest an intergovernmental agreement, in form approved by the City Attorney, with the Fossil Ridge Metropolitan District No. 1 relating to maintenance.
SECTION 2. The City Manager is further authorized to amend the intergovernmental agreement provided such amendments reflect final design decisions regarding the Solterra project or reflect changes in the geographic boundaries of the Solterra project.
INTRODUCED, READ AND ADOPTED by a vote of 11 For and 0 Against at a regular meeting of the City Council on February 11, 2008, at 7 o'clock p.m. at Lakewood Civic Center, 480 South Allison Parkway, Lakewood, Colorado.
